1. Acceptance of Terms & Binding Agreement

By accessing, browsing, registering for, or using LovablePinay.com ("Platform," "Service," "we," "us," or "our") in any capacity — including visiting the website, creating an account, purchasing credits, sending messages, or interacting with other users — you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and our Community Guidelines, all of which are incorporated herein by reference.

If you do not agree to any provision of these Terms, you must immediately cease all use of the Platform and delete your account. Your continued use of the Platform constitutes ongoing acceptance of these Terms as they may be amended from time to time.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification. Your continued use after such notification constitutes acceptance of the modified Terms.

2. Eligibility Requirements

To use LovablePinay, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater)
• Have the legal capacity to enter into a binding contract
• Not be a person barred from using the Service under the laws of your country of residence or any other applicable jurisdiction
• Not have been previously banned, suspended, or removed from the Platform
• Not be a registered sex offender in any jurisdiction
• Not be currently married or in a legally binding domestic partnership (unless legally separated)

By creating an account, you represent and warrant that all of the above conditions are met. We reserve the right to request proof of age or identity at any time and to terminate accounts that do not meet eligibility requirements.

3. Account Registration & Security

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are solely responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account, whether or not authorized by you
• Immediately notifying us of any unauthorized use of your account

You may not share, transfer, sell, or otherwise make your account available to any other person. We are not liable for any loss or damage arising from your failure to comply with this section. One person may maintain only one account; duplicate accounts will be terminated.

4. User Conduct & Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Platform for any unlawful, fraudulent, or malicious purpose
• Harassing, threatening, stalking, intimidating, or bullying any user
• Posting or transmitting any content that is defamatory, obscene, pornographic, violent, hateful, discriminatory, or otherwise objectionable
• Impersonating any person or entity, or misrepresenting your identity, age, or affiliation
• Soliciting money, financial information, gifts, loans, or donations from other users
• Engaging in commercial activity, advertising, spam, or promotional content
• Attempting to collect personal information from other users for commercial or unlawful purposes
• Using automated systems, bots, scripts, or third-party tools to access the Platform
• Circumventing, disabling, or interfering with security features of the Platform
• Uploading viruses, malware, or any harmful code
• Engaging in human trafficking, prostitution, escort services, or any form of sexual exploitation
• Creating fake profiles, catfishing, or romance scamming
• Using the Platform while under the influence of drugs or alcohol in a manner that leads to abusive behavior
• Contacting users who have blocked you through alternative means
• Sharing private conversations, photos, or personal information of other users outside the Platform without their explicit consent

Violation of any of these provisions may result in immediate account termination, forfeiture of credits, and reporting to law enforcement authorities where applicable.

5. User-Generated Content

You retain ownership of content you create and post on the Platform ("User Content"). By posting User Content, you grant LovablePinay a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Platform.

You represent and warrant that:

• You own or have the necessary rights to post all User Content
• Your User Content does not infringe any third party's intellectual property, privacy, or other rights
• Your User Content complies with these Terms and all applicable laws

We reserve the right to remove any User Content at our sole discretion, without notice, for any reason including but not limited to violations of these Terms. We are not responsible for monitoring or editing User Content but may do so at our discretion.

6. Credits, Payments & Refund Policy

LovablePinay operates on a credit-based system. Credits are used to perform certain actions on the Platform (e.g., sending messages, sending gifts, boosting profiles). By purchasing credits, you agree to the following:

• All credit purchases are final and non-refundable except as required by applicable law
• Credits have no cash value, cannot be exchanged for cash, and are non-transferable
• Unused credits do not expire as long as your account remains active and in good standing
• If your account is terminated for violation of these Terms, all remaining credits are forfeited without refund
• Prices for credits may change at any time without prior notice
• Bonus credits awarded by the Platform are complimentary and may be revoked at our discretion

VIP subscriptions, if applicable, are billed on a recurring basis. You may cancel at any time, but no partial refunds will be issued for the remaining billing period.

7. Safety, Risks & User Interactions

IMPORTANT: LovablePinay does not conduct criminal background checks, identity verification beyond optional photo verification, financial checks, or any other screening of users. You acknowledge and agree that:

• You are solely responsible for your interactions with other users, both online and offline
• We do not guarantee the identity, background, character, or intentions of any user
• You should exercise extreme caution before sharing personal information or meeting anyone in person
• We strongly recommend meeting in public places and informing a trusted person of your plans
• We are not responsible for the conduct of any user, whether online or offline
• Any disputes between users must be resolved between the parties involved; we are not a party to such disputes

By using the Platform, you acknowledge that there are inherent risks in interacting with strangers online, including but not limited to risks of fraud, emotional harm, physical harm, and financial loss. You assume all such risks.

8. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, audio clips, software, and the overall look and feel — are owned by LovablePinay or its licensors and are protected by international copyright, trademark, trade dress, patent, and trade secret laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or exploit any materials from the Platform without our prior written consent.

9. Account Termination & Suspension

We reserve the right to suspend, restrict, or terminate your account and access to the Platform at any time, without prior notice, for any reason, including but not limited to:

• Violation of these Terms, Privacy Policy, or Community Guidelines
• Conduct that we determine, in our sole discretion, is harmful to other users, the Platform, or third parties
• Upon request by law enforcement or government agencies
• Extended periods of inactivity
• Unexpected technical or security issues
• Non-payment of fees owed

Upon termination, your right to use the Platform immediately ceases. All provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components
• The results obtained from the Platform will be accurate, reliable, or meet your expectations
• Any matches, connections, or relationships formed through the Platform will be successful or satisfactory
• Any user profile information is accurate, truthful, or current
• The Platform will be available at all times or in all locations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOVABLEPINAY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages
• Any loss of profits, revenue, data, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to or alteration of your data or transmissions
• Any damages resulting from the conduct of any third party or other user on the Platform
• Any damages resulting from any content posted, emailed, transmitted, or otherwise made available through the Platform
• Any personal injury or property damage of any nature resulting from your use of the Platform
• Any damages arising from interactions with other users, whether online or offline

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless LovablePinay, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the Platform
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your interactions with other users, whether online or offline
• Any claim that your User Content caused damage to a third party

13. Dispute Resolution & Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body in the jurisdiction of our principal place of business.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive your right to participate in any class action lawsuit or class-wide arbitration.

JURY TRIAL WAIVER: You and LovablePinay both waive the right to a trial by jury in any proceedings arising out of or related to these Terms or the Platform.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LovablePinay operates, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within that jurisdiction.

15. Third-Party Services & Links

The Platform may contain links to or integrations with third-party websites, services, or applications. We are not responsible for the content, privacy practices, or policies of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.

16. Communication Consent

By creating an account, you consent to receive communications from us, including but not limited to emails, push notifications, in-app messages, and SMS messages related to your account, matches, promotions, and Platform updates. You may opt out of non-essential communications at any time through your account settings, but operational and account-related communications cannot be opted out of while your account remains active.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, internet disruptions, power failures, or cyberattacks.

18. Severability & Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19. Entire Agreement

These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and LovablePinay regarding your use of the Platform and supersede all prior agreements, representations, and understandings.
